Isn’t it stealing when person takes something not his?

If a person takes, or even instigates the taking of, something that doesn’t belong to him or her, from a building that does not belong to them, is that not stealing? Aren’t thieves arrested and jailed anymore? Just wondering. Gloria S. Brann Skowhegan
