The Somerset County District Attorney is asking that an Anson man who has violated probation conditions several times serve the remainder of the 15-year prison sentence he was originally given for a gross sexual assault conviction in 2001.
Scott Allen Tibbetts, 41, of Anson, is being held at the Somerset County Jail without bail after a motion to revoke his probation was filed by the Somerset County District Attorney’s Office on Thursday.
Earlier this month Tibbetts was arrested on two counts for driving after his license was suspended, said District Attorney Maeghan Maloney.
Tibbetts was convicted of gross sexual assault in 2001. He is alleged to have engaged in a sexual act with a girl under the age of 14 in Anson between 1998 and 1999, according to Maloney, and was sentenced to 15 years in prison, with all but three years suspended and six years probation.
“One of the conditions of probation is always that you will not commit another crime,” Maloney said. Since his release, Tibbetts has violated probation seven times.
“That’s the other reason why we are taking this so seriously, is because there have been so many,” Maloney said. Other violations have included negotiating a worthless instrument and violating conditions of bail, she said.
A motion to revoke probation means that the court can order Tibbetts to serve the remainder of his original sentence. Since he has already served additional time for some of the other violations, the most he could serve at this point is six years and three months.
He is scheduled to appear in Somerset County court on April 7.
