AUGUSTA — A West Gardiner woman who successfully completed a 12-month deferred disposition no longer faces a domestic violence assault charge, which a judge dismissed Tuesday at the Capital Judicial Center.

Kristin Hinckley, 25, formerly of China, had been charged with aggravated assault and domestic violence with a dangerous weapon after her boyfriend ended up stabbed as a result of a fracas over a gun on July 29, 2015, at their home.

She had pleaded guilty a little over a year ago to a misdemeanor charge of domestic violence assault, which said “she intentionally, knowingly, or recklessly caused bodily injury or offensive physical contact” to the victim, and the other two charges were dismissed.

Her plea to the misdemeanor was withdrawn on Tuesday at the Capital Judicial Center and the charge was dismissed. Under the terms of the deferment, she was prohibited from having dangerous weapons and from contact with the victim.

Police investigating the incident reported differing accounts of what occurred, with Hinckley reporting she was a victim of criminal threatening.

The boyfriend said he had been home asleep when Hinckley and their daughter returned from a friend’s home, and she came at him with a gun that proved to be unloaded. He told police he stopped her from getting to a nightstand where the ammunition was kept.

He told police she stabbed him in the shoulder with his hunting knife, then he fled in his underwear and drove to the friend’s home.
